One of the most common questions foreign companies ask before entering the United States is simple to phrase and surprisingly hard to answer: "What license do we need?" There is no single "U.S. business license"

Unlike some countries, the U.S. does not issue one national business license. Requirements are layered across federal, state and local levels, and they vary by activity. A company may need none, one, or several authorizations depending on what it sells and where.

Federal requirements

Certain products and activities are regulated federally — for example, items overseen by agencies responsible for food, health-related products, communications equipment or controlled goods. If your product falls under a federal agency's authority, registration or approval may be required before it can be sold.

State and local requirements

Most general business licensing happens at the state and local level: business registration, sales tax permits, professional and occupational licenses and industry-specific permits. Because each state differs, a product that requires no special license in one state may require one in another.
